All coaching and mentoring services, publications, and communications (whether by email, video, or otherwise) provided by Lyndsey D’Arcangelo (“Coach”),  including  information on this website (lyndseydarcangelo.com), are intended to help you identify the areas in your life, athletic performance, and thinking that may be limiting your growth. Coaching is not professional mental health care, medical care, or sports medicine. If you are experiencing psychological distress that interferes with your ability to function, please seek the help of a licensed mental health professional. Coaching may augment therapy, but the work of coaching is designed for individuals whose major emotional and psychological concerns  are already being addressed or have been resolved. 

In that spirit, by engaging in coaching and/or mentoring services, participating in workshops, or consuming publications and communications from your Coach, you confirm that you have read and agree to each of the following statements:

Nature of Services

I understand that coaching services are not offered as a substitute for professional mental health care, medical care, or sports medicine, and are not intended to diagnose, treat, or cure any mental health or medical conditions. I also understand that my Coach is not acting as a mental health counselor, medical professional, or athletic trainer.

I understand that coaching is, at present, an unregulated industry in the United States and that my Coach is not licensed by the State of New York or any other state as a therapist, counselor, or healthcare provider.  I also understand that for all legal purposes, the services provided by my Coach will be considered to be provided in the State of New York.

I understand that coaching is not a substitute for counseling, psychotherapy, psychoanalysis, mental health care, or substance abuse treatment, and I will not use it in place of any form of professional therapy or treatment.

Personal Responsibility and Informed Consent

I understand and agree that I am fully responsible for my own well-being during and after all coaching sessions, including my choices and decisions. All comments, strategies, and ideas offered by my Coach are intended solely for the purpose of helping me achieve my self-defined goals. I represent that I have the ability to give my informed consent, and I hereby consent to my Coach assisting me in pursuing those goals.

I understand that, to the extent coaching involves career or business matters, my Coach makes no guarantee regarding specific  outcomes, including but not limited to increased clientele, profitability, or business success.

Intellectual Property

I understand that all materials provided by my Coach, whether during sessions or through this website, are proprietary and copyrighted, and were developed specifically for Lyndsey D’Arcangelo LLC. I acknowledge and agree that these materials are licensed to me solely for my personal, individual use under a single-user license. I acknowledge and agree that I may not disclose, distribute, reproduce, or share any such materials with any third party. All intellectual property, including copyrighted programs and course materials, remains the sole property of Lyndsey D’Arcangelo LLC. No license to sell, sublicense, or distribute these materials is granted or implied. I understand that I am not authorized to use any of my Coach’s intellectual property for my own business purposes.

Confidentiality

My Coach will treat my personal information as confidential unless I provide written authorization to the contrary. I acknowledge that my Coach may be required to disclose information in the following circumstances: (a) if I report or Coach reasonably suspects child, elder abuse, or neglect; (b) if I express an intent to harm myself or another person; or (c) if my Coach is compelled by court order or other legal process to provide information or testimony. In each case,  confidentiality obligations will be limited to the extent required by law. I further understand and acknowledge that electronic communications, including email, texting messaging, Zoom, and similar technologies, are not guaranteed to be secure, and I accept the inherent risks to confidentiality associated with their use. 

Limitation of Liability and Release

To the fullest extent permitted by law, I hereby release, waive, and discharge my Coach, together with any agents, successors, assigns, personal representatives, executors, heirs and employees, from and against any and all claims, suits, actions, demands, or right to compensation for damages arising out of or in connection with any acts or omissions by myself or by my Coach, including any  advice given or other interactions  resulting from the coaching relationship. I further represent that no promise, inducement, or agreement not expressed herein has been made to me in connection with these terms. These terms  shall be binding upon my heirs, executors, personal representatives, successors, assigns, and agents.

Governing Law

These terms and any dispute arising out of or relating to the coaching relationship between me and Lyndsey D’Arcangelo, LLC shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflicts of laws principles. I consent to the exclusive jurisdiction and venue of the state and federal courts located in the State of New York for the resolution of any such dispute.
